Terms of Service for FirstTherapy

Welcome to FirstTherapy, a platform operated by TheBrainPsych (referred to as "we," "our," or "us"). These Terms of Service apply to all FirstTherapy services, including the FirstTherapy.org website and the FirstTherapy mobile application available on iOS and Android (collectively referred to as the "Platform"). By using any part of the Platform, you agree to the following Terms of Service. If you do not agree, please do not use the Platform.
1. Nature of Service
FirstTherapy facilitates connections between individuals seeking therapy ("Users") and independent psychologists or counselors ("Practitioners") through our website and mobile apps.
- We act solely as a matching service and are not involved in the therapeutic relationship.
- The Practitioners on our platform operate independently and are not employees, agents, or affiliates of FirstTherapy.org or TheBrainPsych.
2. No Guarantee of Outcomes
- FirstTherapy.org does not guarantee the effectiveness, suitability, or quality of the services provided by Practitioners.
- Any advice, guidance, or therapy provided by Practitioners is their sole responsibility.
3. Limited Liability
- FirstTherapy.org is not liable for:
- The quality of counseling sessions or their outcomes.
- Any decisions, actions, or consequences arising from your engagement with a Practitioner.
- Issues related to payment arrangements for follow-up sessions directly between Users and Practitioners.
- Our responsibility is limited solely to facilitating the initial session.
4. User Responsibilities
As a User, you agree to:
- - Provide accurate information during the sign-up process to ensure appropriate matching with Practitioners.
- - Engage respectfully with Practitioners during and after sessions.
- - Seek additional medical or legal advice, if necessary, as our platform does not provide crisis support or emergency intervention.
- - Provide at least 24 hours' notice to reschedule a session at no charge. Sessions missed without notice, or cancelled less than 24 hours in advance, are non-refundable.
- - Request a refund of a session fee within 24 hours of booking, or within 24 hours of the session taking place, by emailing vd@thebrainpsych.com. Approved refunds are returned to your original payment method.
- - Understand that, given the professional nature of the service and the practitioner time reserved on your behalf, session fees are non-refundable once seven (7) days have passed from the booking or session date.
5. Practitioner Responsibilities
Practitioners are responsible for:
- Conducting sessions professionally and adhering to ethical standards set by their governing bodies.
- Complying with local laws and regulations regarding mental health services.
6. Privacy and Confidentiality
We prioritize the security of your data. Please review our Privacy Policy for details on how your information is handled. Practitioners are independently responsible for maintaining confidentiality during sessions.
7. Crisis Situations and Emergencies
FirstTherapy is not an emergency service and is not designed for crisis intervention. All sessions, including any free or sponsored ("charity") sessions offered through the Platform, are scheduled in advance and take place at a later time. They are not available on demand and must not be relied upon for urgent or emergency support.
- If you are in immediate danger, experiencing a medical emergency, or at risk of harming yourself or others, contact your local emergency number right away (for example, 911 in the United States, 112 across much of Europe, or 112 / 108 in India).
- For urgent mental health support, contact a crisis line in your area, such as the 988 Suicide & Crisis Lifeline (United States), Tele-MANAS on 14416 (India), or Samaritans on 116 123 (UK & Ireland). A directory of free, confidential helplines for 130+ countries is available at findahelpline.com.
- Applying for a session, including a sponsored session, does not create an obligation on FirstTherapy or any Practitioner to provide immediate assistance, and submitting an application should never take the place of contacting emergency or crisis services.
8. Updates to Terms of Service
We may update these Terms of Service from time to time. Continued use of the Platform (including the website and mobile apps) after updates constitutes your acceptance of the revised terms.
9. Governing Law
These Terms are governed by the laws of India. Any disputes will be resolved in accordance with these laws.
